The Mytishchi District Court of Moscow Region has sentenced activist Pavel Krisevich to ten days’ detention under the article for disobeying the police (Article 19.3 of the Code of Administrative Offences). This was reported by lawyer Oskar Cherdzhiev on his social media stories.
An administrative report was filed against the activist because he refused to present his passport to the police.
Krisevich will serve his sentence in a special detention centre in Mytishchi, a city just outside Moscow.
Krisevich was detained yesterday at about 2:30 p.m. and taken to Police Station No. 2 in Mytishchi so that he could sign a warning in connection with the elections. The activist remained at the police station until 6 p.m. After telling his wife that he was going to sign the warning, he lost contact with her.
Later the same evening, it became known that a report was filed against Krisevich for disobeying police officers and that he was held overnight at the station, pending trial.
On 2 September, the Moscow Region Court overturned Pavel Krisevich’s detention order. This was reported on his Telegram channel. The case was sent back to Mytishchi District Court for a new hearing. The judge found that “there are signs in the case of a violation of Krisevich’s right to a defence.”
Krisevich, however, was not released, clarifies RusNews. It is expected that the case will be reconsidered later the same day.
The court refused to consider the defence’s motion to attach video evidence to the case, which the lawyer claimed disproved the accusation. According to the lawyer, the footage shows the artist did not resist, got into the car voluntarily and was taken to the police station of his own accord. Law enforcement, however, claimed Krisevich tried to escape and resisted. Furthermore, despite the defence’s request, the activist’s wife was not questioned at the hearing. She stated that at the time indicated in the official report, her husband was elsewhere—at a shop.
On 3 September, the Mytishchi District Court dismissed the case against Pavel Krisevich due to lack of evidence of an offence. This was reported by lawyer Oskar Cherdzhiev on his Telegram stories.
The defence succeeded in proving that the artist did not resist arrest. The court ruled to release Krisevich.
