Ershov's home was searched on July 14, 2020. In March 2021, a criminal case was opened for participation in the activities of an extremist organization. A recognizance was taken. He was sentenced to three years in a general regime colony on January 19, 2022. The real term was replaced with a suspended term by the court of appeals instance on April 7.
