The altercation leading to the murder was allegedly motivated by a dislike for the informal punk movement.
Konstantinov has provided an alibi, stating that on the 3rd of December 2011, he was attending his mother's birthday party on Prospekt Mira. There is no evidence linking him to the crime scene on the other side of the city. The prosecution's case relies on the testimony of witness Alexei Sofronov, and there are concerns about the identification process, with allegedly falsified interrogation protocols of the witness. Sofronov himself has faced multiple theft-related charges.
The prosecution sought a 10-year prison sentence in a strict regime penal colony for Konstantinov. However, on the 26th of December, Judge Galina Tyurkina of the Chertanovsky District Court in Moscow decided to return the case to the prosecutor's office for further investigation. The case underwent additional investigation, but the indictment remained unchanged.
During the second trial at the Chertanovsky District Court, the prosecution once again requested a 10-year prison sentence in a strict regime penal colony. On the 16th of October 2014, the court decided to reclassify the charge from murder to hooliganism, ultimately sentencing Konstantinov to three years in a penal colony. He was granted amnesty. On the 20th of October, it was reported that Konstantinov had left Russia.
On the 25th of February 2015, the Moscow City Court upheld the decision in Konstantinov's case.
