On 24 August 2023, he was beaten by a security guard at Moscow's RIO shopping centre after writing Mayakovsky's lines in chalk on the pavement: "War is a wind of corpse stench, war is a beggar factory!". According to Yermishin's wife, he was kicked in the stomach and punched in the head, and when she tried to stand up for her husband, she herself was hit on the head so hard that she fell to the ground. The other guards, according to Yelena, watched what was happening and did not intervene. The Yermishins called the police to the scene, but they did not take a statement about the beatings. Without even identifying themselves, the law enforcers threw Yermishin on the asphalt, knocked his phone out of his hands, handcuffed him, put him in a car and took him to the Butyrsky inter-district department of the Investigative Committee. Yelena was not even allowed to return the phone to her husband. The woman did not know where he was until two o'clock in the afternoon on 25 August, when she received a phone call informing her that Yermishin was detained under criminal articles on violence against representatives of the authorities and insulting them. On 28 August Yermishin was elected a measure of restraint in the form of house arrest. The case file on the court website contained only the article on violence, but the case was initiated under both articles. Later Yermishin was released on his own recognisance. On 24 June 2025, he was given a one and a half year suspended sentence.
